In-N-Out Burger Drum Legend Competition

Welcome to the In-N-Out Burger Drum Legend Competition! We are looking for a legendary drummer among our Associates to perform with In-N-Out’s family band .48 Special at In-N-Out’s 75th Anniversary Festival!

Competition Overview

Competition runs July 19, 2023 through August 20, 2023. Submit a video of yourself showcasing your drumming skills by performing 1-2 songs. You can use background tracks to accompany your performance. We encourage you to play challenging songs that highlight your legendary talent!

Lynsi will select the top drummers to submit a follow-up video performing a song of Lynsi’s choice. A few amazing drummers will then be selected for the final round to perform in-person in front of In-N-Out’s family members’ band, .48 Special! Lynsi and the band will select the winner from the final round.

The winner will have the chance to play with .48 Special in an epic performance at the Rock 2 Freedom Concert during the In-N-Out Burger 75th Anniversary Festival on October 22, 2023 at the In-N-Out Burger Pomona Dragstrip!

You must review and agree to the Competition Rules and Terms below, fill out the required fields, and upload your video submission to participate.

Competition Rules and Terms

To enter the In-N-Out Burger Drum Legend Competition (“Competition”), you must read the Competition Rules and Terms (“Rules”) below and provide your signature to confirm your understanding and acceptance of the Rules.

First Round Video Requirements

• For the first round of the competition, you must submit a video (“Your Video”) of you drumming to one to two songs (“Songs”) in the rock genre. Performances may include portions of Songs. Maximum time limit for Your Video is six (6) minutes.
• Upload Your Video and your information for the Competition using the upload link provided in the entry form on the website inodrumlegend.com.
• You may only submit one video.
• You must name all Songs played in Your Video and disclose all performing and writing credits for the Songs as provided in the fields below.
• The time period to submit Your Video starts July 19, 2023 and ends August 20, 2023. Late entries will not be accepted.
• Your Video must be free of unsafe behavior, or offensive or illegal content. Your Video should not include any other party’s marks, designs, or other intellectual property nor any unauthorized photographs, images, or recordings.
• In-N-Out reserves the right to disqualify or exclude any entrants or videos for any reason, including those that are not timely submitted, not complete, or not compliant with these Rules. All judging will be based on drumming skill and performance.

Second Round Video Requirements

• Lynsi will select the top drummers from the first round video submissions to advance to a second round. Drummers selected for the second round will submit a second video (“Second Video”) of themselves performing a song of Lynsi’s choice.
• In-N-Out family members’ band .48 Special and Lynsi will review the Second Video submissions to select outstanding drummers to advance to a final round.

Final Round In-Person Performance and Winner Requirements

• Drummers selected for the final round shall perform a song of Lynsi’s choice for Lynsi and .48 Special to judge and select a winner. The final round performance will be in person in front of Lynsi and .48 Special.
• The winner will have the opportunity to perform a song with .48 Special during a live stage performance at the Rock 2 Freedom Concert during the In-N-Out Burger 75th Anniversary Festival (“Festival”) on October 22, 2023 at the In-N-Out Burger Pomona Dragstrip.
• The winner will be announced by early October. The winner may be requested to attend practice sessions with .48 Special prior to the Festival.
• To participate in the final round, you must be able to appear to perform in person at the final round date, time, and location selected by .48 Special. To be selected as a winner, you must be available to perform at the Festival and potentially attend practice sessions with .48 Special, and you must abide by any further performance rules at the Festival.

Additional Eligibility Requirements

• You must be 18 years of age to enter.
• You must be employed by In-N-Out: (1) when you submit Your Video and Second Video for the Competition; and (2) during the Festival on October 22, 2023.
• Any liabilities and expenses, including but not limited to Your Video, Second Video, equipment, and travel, shall be your sole responsibility.
  Permissions, Representations, and Warranties
• By participating in the Competition, including submitting Your Video and Second Video, performing in the final round, and performing at the Festival, you grant In-N-Out Burgers and the Slave 2 Nothing Foundation a non-exclusive, perpetual license to display Your Video and Second Video and biographical information about you and your image and likeness, in any media throughout the world for unlimited duration and for any use. This license is effective regardless of whether you are a Competition winner.
• By submitting Your Video and Second Video, you represent and warrant that: you have all rights and permissions from applicable copyright or other rights owners to perform and record your performance of the Songs and to display all images and likenesses in Your Video and Second Video; and you are not subject to any third-party contractual relationship that would prevent In-N-Out from displaying Your Video and Second Video or prevent you from performing at the Festival if you are selected as a winner.
• You agree to indemnify and defend In-N-Out against any claims of infringement, privacy, or use of likeness resulting from your participation in the Competition.
• In-N-Out reserves the right to alter Your Video and Second Video for any purpose, including alterations relating to formatting and video quality.
• You agree that In-N-Out may contact you to obtain more information about you.
• In-N-Out makes no warranty or representation that the Competition and entry procedures will be uninterrupted or free of any defects. In-N-Out is not liable for any harm that results from video submissions, information provided in the Competition, or participation in the Competition.
• All Rules apply to you regardless if you are a Competition winner.
  Additional Terms
• You agree that your participation in the Competition is voluntary, that you assume all risk associated with participating in the Competition, and that you will receive no compensation for your participation in the Competition. You may only receive a non-monetary prize if you are selected as a Competition winner.
• With your participation in the Competition, you agree to be bound by these Rules and the decisions of In-N-Out, which are binding and final on matters relating to this Competition.
• Your agreement to these Rules remains in effect during and after completion of the Competition.
• In-N-Out will have no liability for any videos or Competition entries that are lost or not received by In-N-Out.
• In-N-Out has no obligation to display or use Your Video or Second Video.
• You agree to indemnify, defend, and hold harmless In-N-Out against any claims of infringement, violation of privacy, unauthorized use of name, image, or likeness, personal injury, death, or other injury or damage relating to any part of your participation in the Competition.
• You release In-N-Out from any and all liability, loss, or damage arising from or in connection with your participation in the Competition, and you further waive all rights under California Civil Code, Section 1542 which states: A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS WHICH THE CREDITOR DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR FAVOR AT THE TIME OF EXECUTING THE RELEASE, WHICH, IF KNOWN BY HIM OR HER MUST HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR.
• You are responsible for all of your own expenses for participating in the Competition.
• In-N-Out reserves the right to cancel the Competition or modify the Competition and these Rules in its sole discretion.
• The Competition and Rules are governed by the laws of the State of California, without giving effect to any choice or conflict of law rules, and you agree that the exclusive venue for any dispute relating to this Contest and rules will be in Orange County, California, wherein you consent to personal jurisdiction of the state and federal courts of Orange County, California.
• This Competition is subject to all applicable federal, state, and local laws. Void where prohibited.
